Interrogatories are questions that are written down and sent to your attorney by the defense. You should know that many of the questions in auto accident cases are standard questions that are approved by the Florida Supreme Court. After interrogatory questions are sent to your attorney, your attorney should then call you, and then your attorney or paralegal from your attorney’s office should sit down with you and obtain the answers.
Many of the questions include what is your name, how did the accident take place, do you have a criminal record, what could you have done to avoid the accident, what doctors did you see before the accident and which doctors have you seen after the accident. These questions are designed to give everyone a basis to continue with the discovery process (the gathering of information for the other side). It is important to answer interrogatories honestly and accurately but know that if you make a mistake, an interrogatory can be updated at any time. This should not be an excuse to not give thoughtful answers to interrogatory questions. It is very important that they are answered accurately because it can be used against you in a court of law if you are not truthful. Interrogatory questions are not difficult to answer and as long as you give an answer to the best of your ability you will not have any problems with your interrogatory answers at trial or at any time during the litigation process.
The last thing you should know about interrogatory answers is that you will have to swear to the accuracy of those answers under oath. Most of the tricky questions will also have a caveat to the answers which say that they are answered to the best of your ability and you reserve the right to amend at any time. This is done so that you can add or delete information as your memory is refreshed or as your attorney receives documentation.
