Why are people suing JUUL and can I sue JUUL?
JUUL e-cigarette lawsuits seek damages from the e-cigarette manufacturer for intentionally and deceptively marketing their products to teenagers and young adults. These products contain high amounts of nicotine, which is designed to get users addicted to JUUL products and create an entire generation of customers for their e-cigarettes. JUUL has been so successful marketing to teenagers and young adults that they have approximately 80% of the e-cigarette market.
JUUL e-cigarettes have led to extremely serious lung conditions and even 6 deaths have occurred from their use. The high amount of nicotine in JUUL products have lead to a large number of teenagers and young adults becoming addicted to JUUL’s products, greatly increasing their use.
One JUUL vaping vial (pod) contains as much nicotine as an entire pack of traditional cigarettes. JUUL intentionally markets and creates JUUL products in order to attract teenagers to use their products by producing flavors such as different fruits and bubble gum. The deceptive marketing to teenagers and young adults is designed to get young people addicted to JUUL products and create an entire generation of nicotine dependant JUUL users.
Nicotine poisoning from the use of JUUL e-cigarettes
Some of the types of injuries that JUUL users have suffered include convulsions, seizures, various lung diseases, and even death. One high school athlete has so much lung damage due to using JUUL e-cigarette products that his doctors have said he has the lungs of a 70-year-old. Recently two teenagers died due to lung damage caused by vaping.
A published report in the Journal of Pediatrics found that chemicals in “vape juice” that simulate fruit flavors have carcinogenic effects. Some of the chemicals found in this type of “vape juice” are diacetyl, formaldehyde (a type of commonly used embalming fluid), toluene (which is commonly found in paint thinners and commercial adhesives) and acrolein (which is commonly used to kill plants and algae in water treatment ponds and irrigation canals).
The carcinogenic effects of these chemicals cause serious and irreversible lung disease. It also causes a type of lung disease known as “popcorn lung” and bronchiolitis obliterans. Some of the signs of this type of lung disease including coughing, wheezing and shortness of breath, which are the same symptoms someone would have if they had a chronic pulmonary disease.
Vape products can also produce dangerous heavy metal particles such as cadmium, chromium, lead, manganese, and nickel all of which become lodged in lung tissue. This happens as the device is heated. Vaping liquids also contain additional carcinogens, such as nitrosamines, that are known to cause lung cancer.
The following are symptoms of nicotine poisoning:
- Strokes
- Seizures
- Convulsions
- Elevated blood pressure
- Heart injuries
- Joint pain
- Blood clots
What’s in JUUL e-cigarettes?
JUUL e-cigarettes are designed to be easy to use and portable. The liquid used to deliver the nicotine contains chemicals such as propylene glycol and glycerin. When this liquid is heated it is inhaled which is why it is referred to as “vaping”. The much higher concentration of nicotine in the JUUL delivery system, which is much higher than almost all other forms of tobacco products, is absorbed into the body at a higher rate.
It is primarily teenagers who have become addicted to e-cigarettes, specifically JUUL products, and numerous reports have been made to the Food and Drug Administration of those who have become addicted to JUUL and other e-cigarette devices.
Many of the JUUL lawsuits claim that JUUL specifically designed their products to be sleek and attractive to younger people in addition to being small so that it could fit in the palm of someone’s hand. JUUL intentionally did this, according to the lawsuits, so that the nicotine could be inhaled without the presence of odors that typically accompany burning cigarettes. Additionally, JUUL intentionally and deceptively marketed their products to teenagers and young adults as safer than cigarettes. As a result, an entire generation has been targeted by JUUL to make them become addicted to their products so that JUUL could make hundreds of millions, if not billions, of dollars.
JUUL has the largest market share of all e-cigarette and vaping products. JUUL aggressively advertises their products to make them seem “glamorous” to young adults. This can be seen from the high percentage of high school students and college students who are now vaping. The results of JUUL’s marketing efforts are that the downtrend of smoking has now been reversed.
